All equipment covered by this agreement must be in good working condition at the time you sign up for the program and must conform to all industry standards and any and all local, state federal and national codes. Pipes or plumbing that are damaged as a result of freezing are excluded. Company reserves the right to require proof in writing of previous service records prior to service
Covered items:
- Pressure Regulators
- Valves: shower, tub, diverter, riser, angle stop and gate valves
- Leaks in breaks of water lines and or plumbing line as part of the interior plumbing of the home
Plumbing Stoppage
- Clearing of stoppages in sink, tub, shower drains and toilets. Clearing of sewer and mainline stoppages (including hydrojetting if stoppage is unable to be cleared with cable) to 100 feet of point of access where ground level clean out is existing.
- Plumbing Stoppage has a maximum allowance of $200 per occurrence and a maximum of one clean out per calendar year. In the event the stoppage exceeds the maximum allowance homeowner will responsible for any additional charges.
- Monthly pay customers are not eligible for a drain cleanout until they have reached 90 days of active service.
In the event of a plumbing failure there is a repair limit that will be imposed in the first six months of $500. After the initial six months, there will be a maximum of $1,500.00 per aggregate year. In the event that the parts are no longer made or available a comparable substitute will be attempted. If no substitute is possible there is no coverage available under this agreement.
All occupied homes, condominiums and town homes are eligible
This agreement provides coverage on a monthly/quarterly/annual basis. The term of this agreement begins 30 days after we receive your first payment. It will be automatically renewed until terminated. Coverage ends in the event of non-payment.
We are not responsible for upgrades. Company is only responsible for providing access for covered plumbing repairs through unobstructed walls, floors or ceilings. Coverage for diagnosis, access or replacement of item located in or below a concrete slab and items encased in or covered by concrete is limited up to $500.
If it is determined that the coverage under this contract does not apply, or no covered breakdown is discovered, you will be responsible for the entire cost of the repair visit.
If you are delinquent in your monthly payments at the time of service, your service request will be denied.
In the event there is any other collectable insurance, warranty or guaranty coverage available to the purchaser covering a loss also covered under this club plan, this contract will pay in excess of and not contribute with other insurance, warranty or guaranty.
The price of this service may be adjusted from time to time. Notice of any price adjustment will be given to you, in writing at least 30 days prior to implementation. You may terminate coverage by given written notice prior to the effective date of increase.
Plumbing Club is fully transferable, please contact customer service for rules.
This Document, together with the Addenda items incorporated by reference and any Exhibits, constitutes the full, complete, absolute, and entire agreement between Company and Dealer, superseding any prior written or oral representations, agreements, or understanding between the parties relating to this Agreement or the subject matter hereof. Dealer warrants and acknowledges that there are no other agreements or understandings between the parties except as specifically agreed to herein and that any future representation, agreement, understandings, or waivers to be binding upon parties hereto, must be reflected in writing signed by both parties.
The agreed upon fee for your Plumbing Club is outlined on your welcome letter. Application Fee is non-refundable.
Hold Harmless. You shall keep, save and hold harmless United Septic Plumbing Club from any and all damages and liability arising out of any fault or negligence by You or any failure on Your part to comply with any of the covenants, terms and conditions herein contained. In case United Septic Plumbing Club shall, without fault on its part, be made a party to any litigation commenced by or against You, You shall protect and hold United Septic Plumbing Club harmless and shall pay all costs, expenses and reasonable attorneys’ fees incurred or paid by hold United Septic Plumbing Club in connection with such litigation. You shall also pay all costs, expenses and reasonable attorney’s fees that may be incurred or paid by hold United Septic Plumbing Club in enforcing the covenants and terms of this Agreement. We are not liable for the negligence or other conduct of the Service Provider, nor are We an insurer of Service Provider’s performance.
Exclusions
- Pre-existing conditions, defects or deficiencies.
- Any loss or damage arising directly or indirectly from nuclear radiation, nuclear reaction, or radioactive contamination however such nuclear radiation, nuclear reaction, or radioactive contamination may have been caused.
- Stoppages caused by foreign objects, roots, collapsed or broken lines outside the foundation, access to drain or sewer lines from roof and costs to locate, access or install a ground level cleanout.
- Consequential, indirect, or direct damages, injury or illness caused by delays, non-availability of parts, failure to service, labor difficulties and other conditions beyond the administrator’s control. We reserve the right to use qualified contractors, select parts to be used, and to restrict certain makes or equipment used to fulfill all or any part of our obligation under the terms of this agreement.
- THE LACK OF CAPACITY, IMPROPER INSTALLATION .
- We are not responsible for cabinetry, carpentry, and surfaces of any kind including but not limited to tiles carpet, countertops, marble, etc.
- Fixtures, florescent fixtures, outlets, dials, knobs, cartridges, faucets, filter, shower head, shower arm, shower enclosure and base pan, caulking and grouting, septic tank, hose bibs, flow restrictions in fresh water liens, water condition equipment, sewage ejectors, saunas or steam rooms, whirlpool jets and fires suppression systems.
- Water Softeners and or slab leaks.
The alteration, modification, upgrade, addition or deletion from the covered product, nor does it cover the cost of routine maintenance.
Connecting or upgrading any parts, system, appliance, in order to comply with any federal, state or local laws, regulations ordinances, or codes of utility regulations, or to meet changes in efficiency requirements (including but not limited to, heating system efficiency requirements), or meet current building or zoning requirements, or to correct for code violations. This includes any corrections or upgrades at the time of repair, which are required by law, regulation or ordinance. We are not responsible for service when permits cannot be obtained, nor will we pay any costs relating to permits.
CHARGES FOR PARTS AND SERVICES WITHOUT PROIR CONSENT FROM THE ADMINISTRATOR.
Any services or repair associated with hazardous material, treatment, removal, or disposal. This agreement does not cover, when necessary, the opening of walls, ceiling, or floors. Service also does not include the reseeding or replacing grass. Any material, parts or labor required as a result of abuse, misuse, vandalism, freezing, fire, wind, water, lightening, ice, snow, explosion, mud, earthquake, pet damage, pest damage, acts of God, power or water fluctuations, flooding, riots, or military unrest, damage caused by equipment not covered; repairs covered by manufacturer’s recall, warranty, or other service contract; modifications, improper installation, alterations, unauthorized repair; consequential or inconsequential damage; maintenance; or damage to exterior surfaces. This agreement does not cover accessories or maintenance items.
Consequential Damages. This Agreement does not provide coverage for damage caused by a malfunctioning or inoperable appliance or system, including, but not limited to, water, fire and mold spores. United Septic Plumbing Club, its employees, agents, shareholders or parent company shall in no way be responsible for any damages, whether in contract or tort, for any malfunctioning or inoperable appliance or system.
Cancellation by United Septic Plumbing Club. United Septic Plumbing Club may cancel this Agreement, therefore voiding this Agreement if it is deemed that You have either:
(i) Fraudulent conduct by You;
(ii) Misrepresentations by You;
(iii) Failed to make the require payments to Select;
(iv) Upon mutual agreement between You and Select. In the event Select agrees to allow You to cancel after the thirtieth day, the You shall be entitled to a pro rata refund of payments made regarding Your plumbing club for the remaining term, less an administrative fee and any service costs incurred by Select.
